Cancellation

  1. Cancellation within 24 hours: The student will receive a full refund of their deposit and any rent paid. There will be no further liability for the room.
  2. Cancellation between 24 hours and 5 days: The student will receive a refund of their deposit minus a 50 admin fee, plus any rent paid. There will be no further liability for the room.
  3. Cancellation after 5 days: The student will lose their deposit and will be liable for the rent and the room until one of the following happens:A suitable replacement occupier is found and agrees to take over the accommodation.
    The student pays a reasonable cancellation fee to the property.
    The student has paid all sums due under the contract.
Replacement Tenant AcceptedThis property allows cancellation upon finding replacement tenant.

If the student does not validly cancel their contract, they must pay the full accommodation fees for the entire stay unless all of the following conditions are met:

  1. A replacement occupier, deemed reasonably acceptable by the property, agrees to take over the accommodation for the remaining duration. They will make reasonable efforts to assist in finding a replacement but cannot guarantee availability.
  2. The student pays a reasonable cancellation fee to the property.
  3. The student has settled all outstanding payments under their accommodation contract.

The replacement occupier must not already be residing in their housing. If the student introduces a replacement, that individual will be assigned to the accommodation. If the student does not provide a replacement, they reserve the right to allocate prospective tenants to other available rooms first before assigning a replacement to the accommodation and releasing the student from their contract.

The property reserves the right to terminate the licence at any time by providing notice to the student if:

  1. Any installment of accommodation fees remains unpaid for more than seven days past the due date.
  2. Any other required payment under these terms and conditions remains unpaid for more than 14 days past the due date.
  3. The student seriously or repeatedly breaches any of their obligations.
  4. The student is no longer a registered student.
  5. In the property’s reasonable opinion, the student’s health or behaviour poses a serious risk to themselves, others, or another person’s property, or renders them unfit to live in the building.

Additionally, the property may terminate the contract if the accommodation becomes uninhabitable due to circumstances beyond its control and, despite reasonable efforts, they cannot provide suitable alternative housing.

They may also terminate the contract and reclaim possession if accommodation fees remain unpaid for 14 days or more and they reasonably believe the student has vacated the accommodation. In this case, the student’s licence or tenancy will end as soon as they reclaim possession, and any abandoned property will be handled according to clause 3.8.5 of the terms and conditions.

If the contract is terminated early, they will refund a fair proportion of any pre-paid accommodation fees as soon as possible, provided that a replacement occupant fills the vacancy caused by the student’s departure, ensuring no financial loss to the property.

The conditions outlined in clause 5.2.3 of T&Cs for early release and the "No Refunds" policy in clause 5.3.4 will not apply if the student can demonstrate that the termination is due to the property’s serious or persistent breach of its obligations.
